I primi numeri sulla procedura di conciliazione preventiva, introdotta dalla riforma Fornero per i licenziamenti individuali per giustificato motivo oggettivo (cosidetti licenziamenti economici), danno utili indicazioni per valutare se e come sta funzionando l’istituto.
Secondo i dati del ministero del Lavoro, aggiornati al 31 gennaio 2013, emerge un primo fatto positivo: le direzioni territoriali stanno rispettando i termini, molto stretti, che fissa la legge per svolgere la procedura. In gran parte dei casi, le parti sono convocate entro sette giorni dalla formulazione della richiesta di conciliazione, e la procedura si conclude entro i 20 giorni successivi. Non si tratta di un dato banale, se si considerano le croniche difficoltà della Pa quando deve gestire termini così stretti.
Il dato risulta ancora più positivo se si considera che i tentativi di conciliazione richiesti alla data del 31 gennaio sono molti: sono state, infatti, presentate 12.563 richieste, con alcuni picchi nelle città più popolose (1.042 a Roma, 1.180 a Milano, addirittura 1.450 a Napoli).
Risulta utile analizzare gli esiti di queste richieste: alla data di osservazione 1.124 procedimenti risultavano ancora pendenti, mentre 1.831 si sono estinti per mancata comparizione delle parti. Le procedure concluse con un accordo tra le parti sono state 3.958, e il numero di quelle concluse con un mancato accordo è quasi identico, 3.638. Sommando le liti concluse con un accordo ai procedimenti abbandonati spontaneamente dalle parti, si scopre che quasi metà dei licenziamenti sono stati abbandonati o conciliati grazie alla procedura (il 46%), presumibilmente in cambio di una transazione economica oppure, in alternativa o in aggiunta, di un servizio di outplacement.
Si tratta di un risultato sorprendente, ma è ancora presto per cantare vittoria. L’esperienza ci consegna esempi di successo delle procedure di conciliazione, ma anche storie di fallimenti strutturali, come quello del tentativo obbligatorio di conciliazione che, fino al 2010, doveva precedere tutte le cause di lavoro.
Il grande numero di conciliazioni raggiunte potrebbe essere legato, almeno in parte, all’incertezza che aleggia intorno alla nuova disciplina dei licenziamenti: ancora non ci sono sentenze che hanno definito i contorni del nuovo regime sanzionatorio e la procedura accelerata introdotta dalla legge Fornero mostra delle crepe interpretative che ne stanno depotenziando l’efficacia (si pensi solo che, da un Tribunale all’altro, cambiano le interpretazioni su quali controversie sono soggette al rito, e quali sono le conseguenze per chi non applica correttamente le sue regole).
Un altro fattore, meno episodico e più strutturale, che può aver aumentato il numero delle conciliazioni può essere la regola, introdotta dalla riforma, che consente l’accesso all’Aspi alle persone che risolvono, nell’ambito della procedura obbligatoria, il proprio rapporto di lavoro. In passato le persone che risolvevano il rapporto di lavoro doveva escogitare gli stratagemmi più spericolati per accedere al trattamento di disoccupazione, in quanto questo spetta solo a chi ha perso il lavoro contro la propria volontà.
Con la novità della legge Fornero, viene meno questo problema per chi risolve il rapporto all’esito della nuova procedura.
