Il dipendente che, alla fine del periodo di comporto unisce l’aspettativa per malattia non può essere licenziato prima che scada l’intero periodo. La corte di Cassazione, con la sentenza 6711 del 18 marzo, considera illegittima la massima sanzione intimata, da un’impresa.
Nelle intenzioni dell’azienda il licenziamento, doveva scattare con effetti differiti al termine del periodo di aspettativa non retribuita, chiesto dalla dipendente e concesso dalla ditta a partire dall’ultimo giorno del comporto. La Suprema corte ricorda che l’articolo 51 del contratto nazionale di lavoro per i dipendenti delle imprese di pulizia prevede che: “Superati i limiti di conservazione del posto, l’azienda su richiesta del lavoratore concederà un periodo di aspettativa non superiore a 4 mesi durante il quale il rapporto di lavoro rimane sospeso a tutti gli effetti senza decorrenza della retribuzione e di alcun istituto contrattuale”.
Per i giudici di piazza Cavour non c’è dubbio che l’espressione “il rapporto di lavoro rimane sospeso a tutti gli effetti” vuol dire che il vincolo contrattuale resta valido per il periodo dell’aspettativa e il termine per il licenziamento deve dunque slittare.
Un’altra sentenza “garantista” della Cassazione nei confronti del lavoratore ammalato è stata depositata il 1° marzo scorso. In quell’occasione la sezione lavoro (5156) ha affermato il diritto al massimo periodo di “tolleranza”, la cosiddetta sommatoria, che dilata il comporto fino a 14 mesi in presenza di malattie riconducibili a un unico evento. Nel caso specifico si trattava di Aids, ma il datore di lavoro negava il collegamento tra le diverse patologie.
Escluso invece (sentenza 7946 del 2011) il licenziamento per il superamento della “deadline” se il malanno dipende dalle mansioni svolte o dall’insalubrità dell’ambiente di lavoro.
