Con il turbo nel motore, il ddl anticorruzione viaggia verso il sì definitivo. Questione di giorni: l’esame parte oggi in commissione, alla Camera, ma l’aula se ne occuperà già lunedì prossimo, 29 ottobre, e l’approvazione (senza modifiche) è attesa entro i primi giorni di novembre.
Una timing obbligato, si spiega, perché su Montecitorio incombe la legge di stabilità e l’anticorruzione rischierebbe di slittare a dicembre. Di qui la fretta. Del resto, l’accordo tra governo e maggioranza è blindare il testo del Senato. Partita chiusa, insomma, senza correzioni nemmeno sui punti più critici elencati dal Csm, come la concussione per «induzione», messo in risalto nel parere che oggi verrà discusso e votato dal plenum. La maggioranza fa muro e – dal Pdl al Pd – bolla ogni proposta di modifica come volontà di «affossare» il ddl e non, invece, di migliorarlo per evitare, come scrive il Csm, che si verifichi «un arretramento particolarmente significativo dell’attività di contrasto» dei comportamenti corruttivi e che la legge si riveli «incoerente con le intenzioni che la animano» (la citazione si riferisce alla concussione).
Ma neanche il faro del Csm serve a smuovere su questo punto la maggioranza. Che preferisce parlar d’altro, giocare al rimpallo di responsabilità e addebitare alcune lacune della legge, come il falso in bilancio, ad altri (Confindustria, secondo quanto riferito da un’agenzia di stampa). Sta di fatto che il reato, abolito nel 2001 dal governo Berlusconi non è più stato toccato da nessun governo e, in questa legislatura, il ddl dell’Idv si è fermato a giugno in aula senza che nessuno lo abbia sbloccato.
Sulla concussione, l’unica voce fuori dal coro è quella dell’Idv: secondo Federico Palomba, tanta fretta sul ddl si spiega solo con «l’effetto-amnistia» sui processi in corso per concussione per «induzione». Analogo allarme lo ha lanciato il capo della Procura di Torino Giancarlo Caselli: «Poiché, statisticamente, la concussione per induzione è di gran lunga la più frequente, c’è il rischio, praticamente la certezza, che in futuro si lavori a vuoto, mentre per il passato (essendo la nuova norma retroattiva) potrebbero risultare di fatto cancellati moltissimi processi, come quello Penati (a gennaio è attesa la decisione del Gup sul rinvio a giudizio, ndr) o Ruby-Berlusconi (la sentenza dovrebbe arrivare a dicembre, ndr)». Peraltro, la modifica determinerà anche il ricalcolo (al ribasso) di pene già irrogate in primo o secondo grado. Sulla norma (oltre che su prescrizione, autoriciclaggio, falso in bilancio, corruzione tra privati) si appuntano anche le critiche dell’Anm, sebbene finora sia prevalsa la linea di approvare comunque la legge e poi di integrarla.
Mario Monti ha detto che la legge servirà a «migliorare la vita civile dei cittadini» ma avrà anche «un grande effetto sull’immagine del Paese all’estero». Quanto alle critiche, sono allo studio integrazioni da introdurre con decreto o con ddl. Si parla di fine novembre. Politicamente lo spazio è stretto, com’è stato finora, salvo colpi di scena. Le integrazioni riguardano in particolare la prescrizione, per sospenderla dopo una condanna di primo grado e fino all’appello così da dare un po’ più di ossigeno ai processi, compresi quelli per concussione che con l’abbassamento della pena (da 12 a 8 anni) e quindi della prescrizione (da 15 a 10 anni) rischiano di morire prematuramente, asfissiati dalla nuova legge. Il ministro della Giustizia Paola Severino dovrà verificare la praticabilità delle nuove norme. Delle quali, d’accordo con il vicepresidente del Csm Michele Vietti, parlerà in uno dei prossimi plenum, mentre non parteciperà a quello odierno per l’approvazione del parere.

Il “rinforzo” al Ddl anticorruzione non sarà facile soprattutto sulla prescrizione. Anche se qualche idea già circola, come quella di una norma processuale che sospenda il decorso della prescrizione dopo la sentenza di secondo grado (o addirittura di primo grado) e che si applichi anche ai processi in corso non ancora arrivati in quella fase

Il voto di scambio è il voto dato regolarmente da un elettore, ma non motivato da scelte politiche e corrotto da qualche tornaconto. Alcuni avrebbero voluto istituire questo nuovo reato nel Ddl anticorruzione. Ma il ministro della Giustizia Paola Severino ha detto che se ne discuterà ora, ma «serve accortezza, perché è un reato difficilissimo da tipizzare»
