Non è passibile di sanzione penale il medico che in regime di intramoenia utilizza uno strumento diagnostico (nella fattispecie un ecografo), con finalità di “terzo occhio” diagnostico, atto a supportare una diagnosi differenziale e giungere al chiaro inquadramento clinico, non incassando dal cittadino e, conseguentemente non versando, il corrispettivo per l’esame eseguito. Con questa motivazione la Cassazione penale, sezione VI (sentenza n. 20414/2014 del 9 maggio) ha ritenuto correttamente motivata la decisione del giudice dell’udienza preliminare presso il Tribunale di Grosseto, che ha dichiarato di non doversi procedere per il reato di peculato previsto dall’art. 314 del codice penale, contestato a un chirurgo e all’infermiere che lo aveva assistito.
Il reato di peculato è specifico del pubblico ufficiale o l’incaricato di un pubblico servizio che, avendo per ragione del suo ufficio o servizio il possesso o comunque la disponibilità di denaro o di altra cosa mobile altrui, se ne appropria. Secondo l’accusa, i due sanitari avevano utilizzato l’ecografo e si erano appropriati delle ecografie realizzate in regime di libera professione senza versare il corrispettivo all’Asl e senza che fossero registrati la prestazione e il compenso.
Ad avviso del Gup, gli inquirenti avrebbero proceduto in base a un grande fraintendimento, avendo ritenuto configurarsi un illecito ogniqualvolta dall’esame delle cartelle, dalle testimonianze dei pazienti o dalle conversazioni intercettate, si era accertata l’effettuazione di una ecografia. In realtà, come chiarito dal medico coinvolto e come attestato dal verbale di riunione della Commissione paritetica per l’attività libero-professionale intramoenia dell’Asl coinvolta, si doveva distinguere un esame ecografico vero e proprio, che ha esito in un dettagliato referto, da semplici scansioni ecografiche, effettuate nel corso di visite specialistiche, che vengono eseguite abitualmente a completamento di un esame obiettivo o per immediata risoluzione di dubbi diagnostici e diagnosi differenziali.
Ed era in questo quadro che andavano inserite anche le scansioni ecografiche effettuate nel corso della visita di un paziente anche su zone limitrofe all’addome inferiore, necessarie per una diagnosi più compiuta. Ne deriva che la prassi posta in essere dal medico coinvolto era ampiamente giustificata, oltre a essere, per altro, seguita anche da suoi colleghi del medesimo nosocomio. Il fatto che nelle conversazioni registrate si fa cenno a ecografie o scansioni ecografiche da effettuarsi eventualmente in sede di visita non appare risultanza particolarmente significativa, posto che è pacifico che l’imputato era solito avvalersi di tale mezzo come semplice ausilio a fini diagnostici (“terzo occhio”) e non come veri esami da supportare con appositi referti.
