Prevedere un articolo per valorizzare i precari del Ssn e dare la possibilità, alle regioni sottoposte a piano di rientro, “di procedere al turn over del personale sanitario con limitazioni che non siano incompatibili col mantenimento dei Lea”. Questo chiede la Commissione Sanità del Senato nel parere al Dl Pa. Netta contrarietà della Commissione Lavoro che ritiene che il decreto sappia troppo di sanatoria. Ecco il relativo parere. Ma tornando al parere della Commissione Sanità vi si legge che le peculiarità che connotano gli operatori del settore sanitario devono essere “adeguatamente considerate e valorizzate”, anche attraverso l’introduzione di un articolo ad hoc che preveda l’estensione delle misure finalizzate alla valorizzazione della professionalità acquisita con contratto di lavoro a tempo determinato anche al personale dell’area dirigente.
E inoltre forme di tutela della professionalità degli operatori che prestano la propria attività nell’ambito di rapporti di lavoro non riconducibili al contratto a tempo determinato in senso stretto; requisiti calibrati in ragione della specificità del settore sanitario, e quindi tali da includere nelle procedure concorsuali riservate anche coloro che hanno maturato la richiesta anzianità triennale cumulando esperienze lavorative presso diversi enti del Servizio sanitario nazionale; la possibilità, per le regioni sottoposte a piano di rientro da disavanzo sanitario, di procedere al turn over del personale sanitario con limitazioni che non siano incompatibili col mantenimento dei livelli essenziali di assistenza”.
Questo chiede la Commissione Sanità di Palazzo Madama nell’esprimere il suo parere al Decreto legge “recante misure urgenti per il perseguimento di obiettivi di razionalizzazione nelle pubbliche amministrazioni”. È dunque un parere favorevole ma con condizioni e anche osservazioni.
In particolare, per quanto riguarda l’articolo 1 del decreto he disciplina la limitazione nell’uso ed acquisto di autovetture da parte delle pubbliche amministrazioni, la Commissione Sanità fa notare che “occorrerebbe specificare che la disciplina restrittiva non riguarda l’uso o l’acquisto di mezzi necessari allo svolgimento di servizi a carattere socio-sanitario correlati alla garanzia dei livelli essenziali di assistenza”.
Commissione lavoro. Alt bipartisan «Va riscritto il decreto assumi-precari. Tutto da rifare. Niente “corsia preferenziale” per i precari»
Un decreto legge da riscrivere, quello sulla stabilizzazione dei precari del pubblico impiego approvato il 31 agosto su proposta dal ministro della Pubblica amministrazione, Gianpiero D’Alia, perché sa troppo di sanatoria: assunzioni facili a discapito dei concorsi pubblici aperti a tutti e dell’efficienza gestionale. I posti liberi andrebbero infatti coperti innanzitutto spostando il personale già in servizio. È questo il verdetto della commissione Lavoro del Senato, che ieri ha approvato col voto di tutti i partiti della maggioranza e con l’astensione del Movimento 5 stelle il parere sul decreto 101.
Parere formalmente «favorevole» a patto però che il provvedimento «sia modificato secondo le osservazioni e indicazioni sopra esposte». Che smontano pezzo per pezzo il decreto, chiedendo profonde modifiche, secondo quanto aveva già suggerito il senatore Pietro Ichino (Scelta civica). «In modo da evitare» quattro rischi.
1) L’aumento dei contratti a termine, che gonfierebbe il bacino dei precari (circa 250mila, di cui 134mila nella scuola). La commissione rileva una «contraddizione» tra le sanzioni ai dirigenti che ricorrono a nuovi contratti a termine e la disposizione del decreto che prevede la rinnovabilità dei contratti in corso fino al 2015.
2) «L’affievolimento del principio costituzionale» che nella pubblica amministrazione si entra per concorso.La commissione boccia in particolare la norma che riserva ai precari il 50% dei posti messi a concorso.
3) Il «depotenziamento» delle norme vigenti sulla mobilità dei dipendenti pubblici. Le sanzioni a carico dei dirigenti che non rilevano le eccedenze di organico e avviano le procedure di mobilità per gli esuberi, si legge nel parere, sono state inasprite «per ben tre volte», ma sono «rimaste totalmente disapplicate, al centro e in periferia». Il decreto anziché rimediare finisce per configurare «sanatorie surrettizie per le omissioni passate da parte del management pubblico». Secondo la commissione, l’autorizzazione a nuove assunzioni dovrebbe essere subordinata alla verifica che i posti richiesti non si possano coprire attraverso la mobilità. In questo senso il parere bipartisan boccia anche le 120 assunzioni previste per l’Agenzia per la coesione territoriale istituita dal decreto. Prima appunto bisognerebbe provare a coprire l’organico con personale già in servizio presso le pubbliche amministrazioni.
4) La «deroga al principio programmatico della spending review» quando i precari stabilizzati andassero a occupare posti che si potrebbero coprire trasferendo personale già assunto. La commissione osserva anche che il decreto correttamente subordina la stabilizzazione dei precari al fatto che ci siano posti vacanti e disponibilità finanziarie e questo fa «prevedere che le immissioni in ruolo effettive saranno in numero assai limitato», ma aggiunge che è comunque fuorviante alimentare l’idea che questi precari debbano essere assorbiti esclusivamente nel settore pubblico.
