Il governo dà il via libera al referendum e alla trattativa con la Regione per «nuove e più ampie forme di autonomia». Ma esattamente, su cosa si tratta? Il presidente Luca Zaia ieri ha parlato di «due binari paralleli ma assolutamente distinti». Vediamo dove corrono e, soprattutto, dove possono portare.
Il referendum
La partita, su questo fronte, ormai sembra definita. La legge regionale 15 del 2014 prevedeva cinque quesiti: 1) Vuoi che alla Regione del Veneto siano attribuite ulteriori forme e condizioni particolari di autonomia; 2) Vuoi che una percentuale non inferiore all’80% dei tributi pagati annualmente dai cittadini veneti all’amministrazione centrale venga utilizzata nel territorio regionale in termini di beni e servizi? 3) Vuoi che la Regione mantenga almeno l’80% dei tributi riscossi nel territorio regionale? 4) Vuoi che il gettito derivante dalle fonti di finanziamento della Regione non sia soggetto a vincoli di destinazione? 5) Vuoi che la Regione del Veneto diventi una regione a statuto speciale? Di questi, dopo l’impugnazione del governo di fronte alla Corte costituzionale, ne è sopravvissuto uno soltanto, il primo, quello dal tenore «programmatico» («Retorico al limite dell’inutilità» secondo i suoi detrattori). La Regione aveva ipotizzato di rimettervi mano, d’intesa con Palazzo Chigi, per dettagliare meglio i contenuti di queste «ulteriori forme e condizioni particolari di autonomia», così da ridurre gli spazi di manovra del governo. Quest’ultimo, però, ha intuito la strategia e col sottosegretario agli Affari regionali, Gianclaudio Bressa, ha avvertito: «Diamo il via libera al referendum ma sull’unico quesito che ha passato il vaglio di costituzionalità: quello è e quello rimane, non ne saranno ammessi di diversi». Questa è quella che in questi giorni, con un po’ di confusione, è stata chiamata «la trattativa sul quesito», con l’appendice del tira-e-molla sull’election day a ottobre (abbinata referendum per l’autonomia del Veneto-referendum costituzionale sulla riforma Boschi) chiesto a gran voce da Zaia, che così risparmierebbe i 14 milioni necessari per allestire la consultazione, ma negato da Bressa perché i due quesiti sarebbero antitetici (il primo punta a dare più competenze alla Regione nel nome del federalismo, il secondo a ricentralizzarle a favore dello Stato per favorire una strategia unitaria nei settori chiave per il sistema-Paese).
Il negoziato sull’articolo 116
La trattativa vera e propria è la seconda, quella basata sull’articolo 116 della Costituzione, a cui il referendum dovrebbe dare una plebiscitaria spinta politica. Ancora non è iniziata: partirà solo quando il governo avrà ufficializzato la sua disponibilità nella lettera di risposta al presidente Zaia, risposta attesa a giorni e anticipata da Bressa (il governo dirà «sì»). Qui la questione si fa più complessa. La lista delle materie su cui Zaia vorrebbe estendere le competenze della Regione è molto lunga e articolata ma soprattutto fa riferimento al testo attuale degli articoli 116 e 117, completamente riscritti dalla riforma Boschi che con ogni probabilità entrerà in vigore a ottobre, nel bel mezzo del negoziato. Il governatore chiede di trattenere in Veneto i 9/10 dell’Irpef, dell’Ires e dell’Iva riscosse qui (il «modello Trento e Bolzano» categoricamente escluso da Bressa), denari che verrebbero poi utilizzati per gestire in totale autonomia la sanità (non sarebbe più necessario il trasferimento annuale da Roma da 8 miliardi di euro), l’istruzione (compreso il personale docente e amministrativo), la ricerca scientifica e tecnologica, il governo del territorio, la tutela dell’ambiente e dei beni culturali, i rapporti internazionali e con l’Ue, la protezione civile. A queste potestà, legislative e amministrative, se ne aggiungerebbero poi una miriade di altre, soltanto amministrative, che vanno dalla gestione dei fondi rotativi e di garanzia alla previdenza complementare, dall’energia alle sovrintendenze fino alle scuole paritarie.
Bressa ha spiegato: «Siamo disponibili a trattare ma ci si dovrà concentrare sulle materie che resteranno delegabili anche dopo l’entrata in vigore della riforma Boschi, così da non vanificare tutto il lavoro svolto fino a quel momento». Il che riduce parecchio la lista, eliminando completamente le materie «a legislazione concorrente» tra Stato e Regioni oggi elencate al terzo comma dell’articolo 117 . Restano dunque negoziabili l’istruzione, la ricerca scientifica e tecnologica, la tutela dell’ambiente e dei beni culturali, il governo del territorio, le politiche attive del lavoro e la formazione professionale, il commercio estero, la giustizia di pace, le politiche sociali (soltanto nelle linee generali). Sono sicuramente meno di quelle contenute nelle 37 pagine spedite a Roma da Zaia, ma non sono comunque poche, se si pensa che comporteranno pure il trasferimento del relativo personale e delle relative risorse. Come sempre quando si ragiona sulle norme costituzionali, è chiaro che si tratta di «titoli» (l’istruzione, l’ambiente) che andranno poi declinati e riempiti di contenuti e proprio questo è lo scopo della trattativa che non sarà né facile, né breve. Il che spiega perché Zaia abbia deciso di farsi affiancare da un board tecnico composto da tre professori del Bo: i costituzionalisti Luca Antonini e Mario Bertolissi e il professore di Scienza delle Finanze Carlo Buratti.
