Nella sua personalissima battaglia per la trasparenza e la legalità, ispirata dalla maxi inchiesta sul Mose, il consigliere di Forza Italia Moreno Teso mette a segno un nuovo punto, il secondo dopo quello che ha costretto Palazzo Balbi a mettere a gara tutti i lavori di ripascimento delle spiagge, sottraendoli al monopolio di fatto del Magistrato alle acque e del Consorzio Venezia Nuova.
Nell’ambito della discussione sul bilancio 2015, il consiglio regionale ha infatti approvato ieri, all’unanimità, un emendamento (formalmente presentato dal correlatore di minoranza della manovra, il democrat Piero Ruzzante) che recepisce la proposta di Teso di sottoporre al voto dell’aula la scelta della giunta di non costituirsi parte civile nei processi che vedono imputati gli amministratori o i dirigenti della Regione, ad esempio per concussione o corruzione. «Fino ad oggi – spiega il forzista – la scelta della giunta è sempre stata discrezionale. A volte la costituzione di parte civile è stata fatta, altre volte no, ma sempre la decisione è stata presa a porte chiuse al piano nobile di Palazzo Balbi. Con questa norma stabiliamo che l’interesse dell’ente, e dunque dei cittadini, va perseguito sempre, obbligatoriamente. E se la giunta preferisce non farlo, deve venire in consiglio, motivare la sua scelta e sottoporsi al voto dell’aula, con un’assunzione di responsabilità politica e un atto di trasparenza».
La norma, approvata nonostante la contrarietà del relatore di maggioranza Costantino Toniolo e la richiesta di un approfondimento tecnico-legale del vice governatore Marino Zorzato (entrambi Ncd, entrambi hanno poi votato comunque a favore) stabilisce che la giunta sia obbligata ad avviare causa civile di risarcimento del danno anche in caso di patteggiamento, quando a norma del codice di procedura la costituzione di parte civile non è possibile. «In questo modo i colpevoli eviteranno di cavarsela con pene irrisorie – prosegue Teso – e dovranno restituire alla Regione il maltolto fino in fondo». Va da sé che nelle mire del forzista c’è proprio l’azione di risarcimento nei confronti di chi ha patteggiato nell’ambito dell’inchiesta sul Mose, come lui stesso non ha nascosto ad inizio gennaio, quando depositò la proposta: «La gente ci chiede: come mai Galan, sospettato di essersi intascato 4,8 milioni di euro, se l’è cavata patteggiando 2,6 milioni? E perché Chisso, che secondo gli inquirenti avrebbe ricevuto 4,2 milioni, esce dal processo pagando 2 milioni? Ecco, questa norma prova a dar loro una risposta: d’ora in avanti chi ruba dovrà restituire tutto, fino all’ultimo centesimo. Anche se è un politico. I cittadini ci chiedono discontinuità rispetto al passato».
Proprio la discrezionalità nella scelta processuale di costituirsi o meno parte civile è stata oggetto nei mesi scorsi di arroventate polemiche tra l’esecutivo Zaia e l’opposizione, in particolare il Pd e l’Idv, che accusavano il governatore di «disinteresse». L’avvocatura della Regione ha però replicato di aver sempre proceduto, allorché questo è stato possibile.
