Decreti ingiuntivi a 20 famiglie per oltre 800 mila euro. L’ennesimo capitolo di una vicenda infinita è stato scritto venerdì pomeriggio, quando il Tribunale di Padova ha notificato oltre una ventina di decreti ingiuntivi di pagamento — quattro sono immediatamente esecutivi — ai parenti e alle vittime dello scandalo delle valvole killer.
Decreti per oltre 800 mila euro, a cui tutti gli avvocati (i legali Bruno Bertolo, Jacopo Barcati, Gaetano Bisantis e Alvise Fontanin) si sono immediatamente opposti, annunciando una nuova battaglia a suon di udienze. Ma quei decreti al tempo stesso hanno riaperto una ferita mai cicatrizzata nell’animo di uomini e donne costrette su una sedia a rotelle. O in quello di figli che hanno perso un genitore per colpa di valvole che dovevano salvare vite e che invece si sono rivelate bombe ad orologeria nel petto.
La decisione del Tribunale della città del Santo arriva come un fulmine a ciel sereno e prende le mosse dalla delibera firmata nel settembre 2012 dall’ex direttore generale dell’Azienda Ospedaliera di Padova, Adriano Cestrone. Nel documento a sua firma, l’allora dg aveva dato il via ad una serie di azioni di recupero degli anticipi sborsati dall’azienda dopo la sentenza di primo grado, che aveva visto la condanna dell’ex direttore del Centro di Cardiochirurgia «Vincenzo Gallucci», il professor Dino Casarotto. Condannato per corruzione, lesioni colpose e omicidio colposo in riferimento alla morte di Antonio Benvegnù e di Enzo Barbetta, entrambe causate dalla rottura della valvola cardiaca. Sentenza poi ribaltata in Appello, con l’assoluzione dell’ex primario, confermata dalla Cassazione, che ha calato il sipario sull’iter penale: assoluzione definitiva del professor Casarotto dalle accuse di duplice omicidio colposo e lesioni colpose, con la formula del «fatto non costituisce reato», confermando invece la prescrizione per la corruzione. E dal momento che la sentenza definitiva aveva revocato le statuizioni civili disposte in primo grado (lasciando però aperta la possibilità di una causa civile, peraltro incardinata al Tribunale di Venezia), l’ospedale con una lettera del 23 gennaio 2012 indirizzata alle vittime era arrivato a battere cassa attraverso una «diffida» a «restituire» all’Azienda Ospedaliera di Padova «la somma comprensiva di interessi legali calcolati dall’1 agosto 2009 all’1 gennaio 2012, entro il 29 febbraio 2012».
Da qui si era arrivati alla delibera dello scorso settembre, in cui si lamentava un danno erariale e si dava mandato allo studio legale dell’azienda di recuperare le somme attraverso i decreti ingiuntivi, che venerdì sono stati controfirmati dal Tribunale di Padova. «L’ospedale però si è dimenticato una piccola cosa non del tutto insignificante nel depositare la richiesta di emissione dei decreti ingiuntivi — sottolinea l’avvocato Jacopo Barcati — e cioè di allegare l’accordo sottoscritto nel 2009 tra l’azienda e le famiglie dei pazienti, secondo cui eventuali somme sarebbero state restituite alla definizione di tutti i contenziosi, civili e penali. E nel mio caso c’è una causa civile con udienza fissata nel novembre 2015. C’è amarezza ed è difficile commentare una causa è ancora in corso. Ci sembra fuori luogo quanto fatto dall’Azienda ospedaliera». Per un libro che non vuole sapere di scrivere la sua fine, con la prima pagina aperta nel febbraio 2002, quando la morte di Antonio Benvegnù per la rottura di una valvola cardiaca difettosa impiantata all’ospedale di Padova diede il via ad uno dei più grossi scandali della sanità
