Gli ambientalisti hanno deciso di cambiare strategia: presenteranno una nuova istanza per cercare di bloccare la stagione venatoria. Il Tribunale amministrativo regionale non si è pronunciato: la tanto attesa sentenza non c´è stata
I cacciatori possono tirare un sospiro di sollievo: ieri il Tribunale amministrativo regionale non è entrato nel merito del ricorso contro il calendario venatorio promosso da Lav, Wwf, Lipu, Lac, Enpa e Legambiente, che in un primo momento aveva fatto scattare la sospensiva che per una decina di giorni vietò di sparare a 19 specie di uccelli migratori considerati a rischio.
Il tempo necessario alla Regione per presentare un secondo calendario venatorio che superasse il primo e fare in modo che il giudice monocratico sospendesse la sospensiva su un provvedimento che non c´era più. Questo il motivo per cui ieri i legali delle associazioni protezionistiche hanno deciso di ritirare le loro istanze al Tar, che avrebbe dovuto esprimersi collegialmente. Quindi la caccia va avanti con le modalità finora conosciute.
«Ma la Regione non canti vittoria perché stiamo lavorando a un nuovo ricorso», afferma Massimo Vitturi, responsabile nazionale della Lega antivivisezione per la caccia. «Dato che Venezia ha fatto la furbata di deliberare la fotocopia del calendario venatorio precedentemente deliberato, non aveva senso da parte nostra insistere davanti al Tar affinché si pronunciasse su un provvedimento inesistente». Vitturi chiude con un monito ai cacciatori: «Abbiamo vinto il primo round, avendo visto accogliere la nostra richiesta di sospensiva ai primi di ottobre. Prima o poi vinceremo anche il secondo». Lav, Wwf, Lipu, Lac, Enpa e Legambiente si erano appellati ai giudici amministrativi sostenendo che il calendario venatorio regionale decretava «l´ennesimo massacro di uccelli migratori in barba alle normative europee». Alla luce di quanto è successo ieri a Venezia, il braccio di ferro tra associazioni protezioniste e Regione sembra destinato ad aggiungere nuovi colpi di scena. Intanto anche la segreteria dell´assessore alla caccia Daniele Stival tira una boccata d´ossigeno e dice: «Tanto rumore per nulla. Logico pensare che quella degli anticaccia è una strategia processuale. Certo è che se Lav, Wwf, Lipu, Lac, Enpa e Legambiente pagassero di tasca loro le spese di giudizio anziché, come succede, attingendo dalle tasche dei cittadini, sarebbero più parsimoniosi nell´appellarsi al Tar». Ieri il Tribunale amministrativo è entrato nel merito di un secondo ricorso sulle doppiette: la gestione degli impianti di cattura dei migratori dati in uso ai cacciatori come richiami, i «roccoli».
Già il Tar aveva rigettato la richiesta di sospensiva presentata dalla Lega anti caccia, motivata per supposta inosservanza delle normative comunitarie. La segreteria di Stival spiega che il giudizio sarà depositato la prossima settimana.
