Valgono quasi otto miliardi le norme fiscali su cui è chiamata a pronunciarsi la Corte costituzionale. In tutto, 15 disposizioni di legge tra imposte, agevolazioni e regole procedurali.
Dopodomani – mercoledì 26 febbraio – si apre la camera di consiglio sulla mediazione tributaria e sulla deduzione dell’Irap versata sul costo del lavoro. Per entrambi i dossier, la normativa sollevata davanti ai giudici della Consulta è già stata modificata dal Governo e dal Parlamento, ma non è detto che i correttivi adottati possano azzerare tutte le critiche avanzate dai magistrati delle commissioni tributarie. Ad esempio, per la mediazione obbligatoria, la legge di stabilità non ha sciolto il nodo della lamentata mancanza di indipendenza dei funzionari a cui il contribuente deve chiedere il riesame dell’atto: il reclamo, infatti, va presentato sì davanti a un ufficio diverso da quello che ha emesso l’accertamento, ma pur sempre all’interno dell’agenzia delle Entrate.
L’esito del giudizio sulla mediazione non ha grande rilevanza per le casse pubbliche, dato che la relazione tecnica stima solo 103 milioni di maggiori incassi all’anno. Ma si tratta comunque di una decisione cruciale: la procedura interessa quasi 100mila controversie all’anno e la questione di legittimità è stata sollevata da sette commissioni tributarie.
Tra gli altri dossier “procedurali” ci sono anche l’obbligo del contraddittorio con il contribuente negli accertamenti che contestano l’elusione fiscale, l’applicazione delle sanzioni penali in caso di omesso versamento Iva e le giustificazioni richieste ai professionisti quando il Fisco utilizza le indagini bancarie.
In altre situazioni, l’eventuale bocciatura – totale o parziale – decisa dalla Corte costituzionale non riguarderebbe solo le regole, ma avrebbe effetti pesanti per l’Erario, ora affidato al ministro Pier Carlo Padoan. Basti pensare alla Robin tax pagata dalle imprese energetiche, che secondo l’ultima relazione al Parlamento dell’Authority vale 1,3 miliardi all’anno. D’alsione, che porta ogni anno quasi 600 milioni nelle casse di Equitalia e contribuisce a finanziarne l’attività. La percentuale è stata ridotta dal 1? gennaio 2013 all’8%, ma resta così elevata da costituire quasi una sanzione accessoria. Tant’è vero che il Governo Letta aveva anticipato la sua revisione al 30 settembre scorso, salvo poi lasciar cadere il termine, per non aggravare i conti del concessionario pubblico.
Scorrendo l’elenco delle questioni a rischio di incostituzionalità si scopre una matrice comune a molte delle norme impugnate: la fretta con cui sono state inserite in “decretoni” e manovre finanziarie, senza troppa attenzione alle conseguenze e alle interazioni con altre norme. È un po’ il difetto che colpisce anche le disposizioni che consentono all’inquilino di denunciare il proprietario che gli ha affittato la casa in nero, beneficiando di un canone super-scontato: sette tribunali hanno visto possibili violazioni della libertà contrattuale e di altri diritti. Non male, per una norma varata meno di tre anni fa insieme alla cedolare secca sugli affitti e alla quale le stime iniziali – poi ridotte a un terzo – assegnavano un maggior gettito di oltre tre miliardi.
Ma davanti alla Consulta non finiscono solo le norme tributarie dello Stato. Tra le 15 disposizioni sotto esame, ce ne sono anche tre varate da Piemonte, Lombardia e Sicilia. Come dire: i difetti delle Camere si trasmettono anche ai parlamentini regionali.
