Tempo di revisione per la professione intramuraria, il 28 febbraio è il termine ultimo per le verifiche imposte dal decreto Balduzzi del 2012, che aveva ridefinito i paletti all’intramoenia, la cosiddetta Alpi, (stabiliti dall’art. 1, comma 4 della legge 120/2007). Termina dunque la fase di sperimentazione che autorizzava (in via residuale) lo svolgimento delle attività libero professionali presso studi privati esterni, collegati in rete alle aziende sanitarie, la cosiddetta «intramoenia allargata», che non avevano spazio sufficiente per l’esercizio “dentro le mura” delle proprie strutture. A questo punto nella prossima conferenza Stato-Regioni bisognerà approvare speditamente la bozza di Accordo “in materia di criteri per la verifica del programma sperimentale per la libera professione intramuraria ai sensi dell’art. 1 comma 4 bis) della legge n. 120 del 3 agosto del 2007. n. 120” che contiene i criteri per salvare, rimandare o bocciare gli enti sanitari inadempienti. I dettagli del programma di verifica sull’intramuraria allargata. Entro il 28 febbraio 2015 ogni regione interessata dalla sperimentazione è tenuta ad effettuare la verifica del programma sperimentale per lo svolgimento della attività libero professionale intramuraria, presso gli studi professionali collegati in rete, in base a criteri fissati con accordo sancito dalla Conferenza Stato-Regione. In caso di verifica positiva, la regione, terminando il programma sperimentale, può consentire in via permanente e ordinaria, limitatamente allo specifico ente o azienda del Servizio sanitario regionale dove si è svolta la sperimentazione, lo svolgimento della attività libero professionale intramuraria presso gli studi professionali collegati in rete. In caso di inadempienza da parte dell’ente o azienda del Ssr, provvede la regione o provincia autonoma interessata.
In caso di verifica negativa, tale attività cessa entro il 28 febbraio 2015. Degli esiti delle verifiche regionali viene data informazione al Parlamento attraverso la relazione annuale dell’Osservatorio per l’attività libero-professionale.
Il decreto Balduzzi specifica con chiarezza che: non può essere esercitata Alpi in studi professionali, anche se collegati in rete, ove operino, accanto a professionisti dipendenti in regime di esclusività o convenzionati con il Ssn, anche professionisti non dipendenti o non convenzionati del Ssn ovvero dipendenti non in regime di esclusività. E’ però prevista «deroga, su disposizione regionale, e a condizione che sia garantita la completa tracciabilità delle prestazioni di tutti i professionisti dello studio professionale associato, con l’esclusione, in ogni caso, di qualsiasi addebito a carico dell’ente o azienda del Ssn».
Sanzioni. Le modifiche introdotte alla disciplina dell’Alpi dal decreto Balduzzi inaspriscono anche l’impianto sanzionatorio. Le regioni assicurano il rispetto delle regole in materia anche mediante l’esercizio di poteri sostitutivi e la destituzione, nell’ipotesi di grave inadempienza, dei direttori generali delle strutture sanitarie, i quali rischiano anche la decurtazione della retribuzione di risultato pari ad almeno il 20 per cento.

Fine corsa per il programma sperimentale autorizzato, in via residuale, per lo svolgimento dell’attività intramoenia presso gli studi privati collegati in rete nelle Aziende del Ssn e Enti che non potevano garantire spazi ad hoc per esercitarla. La data del 28 febbraio, fissata dalla legge 120 del 2007 e successive modificazione, che impone alle Regioni di verificare lo stato dell’arte della sperimentazione è ormai prossima. Per questo sarà esaminato nella prima Conferenza Stato Regioni utile, la bozza di Accordo “in materia di criteri per la verifica del programma sperimentale per la libera professione intramuraria ai sensi dell’art. 1 comma 4 bis) della legge n. 120 del 3 agosto del 2007. n. 120” che mette nero su bianco i criteri per la capire quali Aziende sanitarie ed Enti saranno promosse, rimandate o bocciate.
Il programma sperimentale, lo ricordiamo, in linea con quanto previsto dal Decreto Balduzzi, era stato attuato per garantire la piena trasparenza e tracciabilità dei pagamenti dell’Alpi e prevedeva l’attivazione delle infrastrutture di rete per il collegamento, in voce o in dati, tra l’Azienda o l’Ente e le strutture nella quali erogare le prestazioni in intramoenia.
I promossi. Se la verifica sarà positiva, ossia se le Regioni constateranno che sono state messe a regime tutte le indicazioni imposte dalla legge, lo svolgimento dell’attività intramuraria presso gli studi privati collegati in rete da sperimentale diventerà permanente.
I rimandati. Invece nel caso in cui dalla verifica emerga che al programma non è stata data piena attuazione a causa dell’inadempienza dell’Azienda sanitaria o dell’Ente, provvederà la Regione o la provincia autonoma mettendo in atto provvedimenti ad hoc idonei a superare l’inadempienza. In questo caso la verifica sarà rimandata di un anno.
I bocciati. Si chiudono invece i giochi per le aziende e gli Enti che incasseranno parere negativo: tutte le attività autorizzate cesseranno inderogabilmente entro il 28 febbraio prossimo.
I criteri utilizzati. Tra i criteri che le Regioni devono seguire per dare o meno il placet ci sono: la verifica della sottoscrizione della convenzione annuale tra il professionista e le strutture sanitarie del Ssn; la verifica delle infrastrutture di rete per il collegamento, in voce o in dati, tra l’azienda e lo studio del professionista con le modalità tecniche individuate dalla legge; la verifica che il servizio di prenotazione sia stato effettuato esclusivamente attraverso l’infrastruttura di rete. E ancora che sia stata assicurata la tracciabilità del pagamento direttamente alle strutture sanitarie e fissate le tariffe.
